Vancouver, BC – May 2026 — Pierre Poilievre, Leader of the Official Opposition, and Kerry-Lynne Findlay, candidate for leadership of the BC Conservative Party, have issued strong warnings about the BC Supreme Court’s Kawichin ruling and the federal Liberal government’s failure to defend private property rights. In the August 2025 ruling, the court determined that Aboriginal title holds “prior and senior” status over fee simple private property rights — the strongest form of land ownership in Canada. Poilievre described the decision as “unprecedented” and “revolutionary,” blaming the Liberals for Litigation Guideline 14, which instructed federal lawyers not to argue for the seniority of fee simple rights.
Poilievre stated:
“This is an unprecedented ruling… it changes everything. The Liberal government refused to defend property rights in court… Already there are reports of over hundreds of millions of investment being cancelled because land title cannot be secured.”
He noted the federal government, as the named defendant, took no action for eight months and has since signed the Musqueam agreement, further complicating title issues in Metro Vancouver and beyond.
Kerry-Lynne Findlay brought a deeply personal perspective to the fight for property rights, drawing directly from her own experience as a young widow and single mother:
“Before the cabinet table, before Parliament, before I ever put my name on a ballot, I learned what it feels like to lose everything you’ve built. I was a young widow, a single mother. An Aboriginal land dispute ripped the floor out from under my family… I fought back all the way to the Supreme Court and we won.”
She warned that the same radical policies now threaten every British Columbian:
“That fight taught me something I’ll never forget. If you give the radical left an inch, they’ll take everything you’ve got — even your home… Today, across British Columbia, families feel the same fear I felt back then. That nothing you own is truly safe — your home, your land, your property, your freedom, all under threat.”
Findlay tied property rights directly to economic freedom and resource development in British Columbia mining, pledging decisive action if elected:
“For Mining, we will create a single one-stop permitting shop. The government must decide within 1 year or the permit is approved. We can no longer let red tape stand between BC and the wealth beneath our feet.”
She added:
“We can no longer let them treat our resources as a piggy bank and our voices as an inconvenience. That ends now… Section 43 of our Constitution has potential to provide crucial certainty on private property rights for homeowners, farmers, business, investors, and resource developers.”
Findlay positioned the battle for property rights as central to her leadership campaign, declaring:
“We need a real conservative to defend your home, your land, and your right to keep what you’ve built, what you’ve worked so hard for.”
Impact on British Columbia Mining and Investment
The Kawichin precedent — combined with the lack of historic treaties across most of British Columbia — raises the prospect of widespread overlapping claims that could affect millions of hectares with mineral potential. This uncertainty is already chilling investment in British Columbia mining, where secure land title is essential for exploration, permitting, and financing.
Poilievre’s four-point parliamentary motion calls for immediate reversal of the federal guideline, a ban on future agreements that undermine fee simple rights, a 30-day government plan to protect BC property owners, and a parliamentary committee to study long-term solutions. Both leaders argue that without secure private property rights, economic prosperity — including responsible mining development — becomes impossible.
